These Terms of Service ("Terms") govern your access to and use of the InstaCapture mobile application (the "App") provided by InstaCapture ("we," "our," or "us").
By downloading, installing, or using the App, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.
InstaCapture is a mobile app for capturing, organizing, editing, and exporting videos. Features may include camera recording, clip management, on-device video editing, captions and transcripts, shot-list planning, and optional on-device shot-list generation on supported devices.
We may add, change, or remove features over time.
You may use InstaCapture without a paid subscription. The free version includes core capture and editing functionality subject to certain limits, which may include:
Free features and limits may change from time to time. We will not charge you for free features unless you separately choose a paid subscription or purchase.

The specific features included in InstaCapture Pro are described in the App at the time of purchase and may change over time. We will not remove a core paid feature you reasonably relied on without giving you a meaningful alternative or notice where required by law.
InstaCapture Pro is sold as an auto-renewable subscription through Apple's App Store. All payments, billing, and refunds are handled by Apple under your Apple Media Services or App Store account terms.
We do not process payment card information directly.
We may offer multiple subscription options, such as monthly and yearly plans. The plans, prices, and any free trial or introductory offers available to you are shown in the App and on the App Store purchase sheet before you confirm payment. Prices may vary by country or region and are set by Apple in local currency.
Subscriptions automatically renew unless you cancel at least 24 hours before the end of the current billing period. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period at the then-current price, unless a promotional rate applies.
The length of the billing period depends on the plan you select (for example, one month or one year).
If we offer a free trial or introductory price, Apple will display the terms before you subscribe, including when the trial ends and what price will be charged afterward. You are responsible for reviewing those terms before completing purchase.
Eligibility for trials or promotions is determined by Apple and applicable App Store rules.
You may cancel a subscription at any time through your Apple ID account settings. Cancellation stops future renewals; it does not necessarily refund the current period.
To manage subscriptions, visit apps.apple.com/account/subscriptions or use the subscription management options provided by Apple on your device.
If you reinstall the App or use InstaCapture on a new device, you may use Restore Purchases in the App to restore InstaCapture Pro access associated with your Apple ID, subject to Apple's records and our subscription verification systems.
Refund requests are handled by Apple in accordance with Apple's policies. We cannot issue App Store refunds directly. Contact Apple Support for billing disputes or refund requests.
You must be able to form a binding contract in your jurisdiction to use the App. If you are under the age required in your location, you may use the App only with permission from a parent or legal guardian.
Paid subscriptions must be purchased and managed through an Apple ID with authority to make purchases.
You retain ownership of the videos, audio, images, notes, captions, and other content you create or import into the App ("User Content").
You are solely responsible for User Content and for ensuring that:

We may suspend or terminate access if we reasonably believe you have violated these Terms.
InstaCapture is designed to process most User Content on your device. Certain features rely on Apple system services, including speech recognition and, on supported devices, Apple Intelligence.
Subscription management is provided through RevenueCat and the App Store. When you purchase InstaCapture Pro, Apple and RevenueCat process purchase and entitlement information needed to deliver paid features, as described in our Privacy Policy.
InstaCapture's video editing features are powered in part by VideoEditorKit, an open source component distributed under the MIT License. InstaCapture also includes RevenueCat, which is distributed under the MIT License. Full license texts for these and other third-party open source components are included in the App's bundled `ThirdPartyNotices.txt` file.
When you use the iOS share sheet, photo library, or other system integrations, those services are provided by Apple or third parties under their own terms and policies.
InstaCapture is a creative tool. It does not provide legal, safety, journalistic, or professional production advice. You are responsible for how you capture and publish content.
The App, including its design, branding, and underlying software (excluding your User Content), is owned by InstaCapture or its licensors and is protected by applicable intellectual property laws.
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms, unless we agree otherwise in writing.
An active InstaCapture Pro subscription does not grant you ownership of the App or any intellectual property in it. It grants access only to the paid features described in the App for the subscription term.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the App will be uninterrupted, error-free, secure, or compatible with every device, format, or workflow.
We do not guarantee that subscription verification, restore purchases, or third-party services will always be available without interruption.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, INSTACAPTURE AND ITS OWNERS, DIRECTORS, EMPLOYEES, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE APP OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR INSTACAPTURE PRO OR OTHER PAID APP SERVICES IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) USD $50.
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
You agree to defend, indemnify, and hold harmless InstaCapture from claims, damages, losses, and expenses (including reasonable legal fees) arising out of your User Content, your use of the App, or your violation of these Terms or applicable law.
If you downloaded the App from Apple's App Store, your use is also subject to Apple's applicable terms, including the Licensed Application End User License Agreement and Apple Media Services Terms. Apple is not responsible for providing maintenance or support for the App.
For subscription purchases, billing, cancellations, and refunds, Apple's terms and processes apply. Apple is a third-party beneficiary of applicable App Store license terms.
In the event of any conflict between these Terms and Apple's mandatory App Store terms, Apple's terms govern to the extent required for App Store distribution.
We may modify the App, subscription offerings, free-tier limits, or these Terms at any time. If we make material changes, we will post the updated Terms at instacaptureapp.com/terms-of-use and update the "Last Updated" date.
Your continued use after changes become effective constitutes acceptance of the revised Terms. Price changes for subscriptions already purchased are handled by Apple under its policies.
You may stop using the App at any time by uninstalling it and canceling any active subscription through Apple.
We may suspend or terminate your access if you violate these Terms or if we discontinue the App. Termination does not entitle you to a refund except as required by law or Apple's policies.
Sections that by their nature should survive termination will survive, including ownership, disclaimers, limitation of liability, indemnification, and subscription-related provisions that apply to past transactions.
These Terms are governed by the laws of the State of California, United States, without regard to conflict-of-law principles, except where mandatory local consumer protection laws apply.
